Thanks for all the responses guys. I guess I will have to chat with my engineer to be sure. However, the ADR, whilst it states that all adjustment mechanisms must be locking, it does not say the adjustment mechanism has to be there.

Actually, this seems to be a common peculiarity of the ADR's. If you look at ADR11 for sun visors, it states the rules that apply if you have them. But where is the rule that says you have to fit them in the first place?
