You can't legally smog, title, and thus drive a NEW specially-constructed vehicle (SPCNS) on California roads without it.

A previously legally titled car from another state could be legally titled without it under the "full faith and credit" statute(s), but I certainly would just go through the process and not have to worry about changing laws and smog requirements in the future.
