Yep, the only way to never lose in litigation, is to never litigate to begin with.
If you're not prepared to duke it out to the end, you probably shouldn't throw a punch to get it started. Who knows, perhaps he's had it all reviewed by some really smart folk who opined
"in the end, you might win, or you might lose... really, this one's a coin flip." The whole thing doesn't really make a lot of sense to me. But, then again, I don't know a tenth of the story.
