Computeworks/Ron,please move my responce here to the lounge or whatever it takes,I'm not sure how to do it....Also,I agree,this "lawyer" stuff should not be on this topic,please excuse me for replying to Evans last post....

Evan;

I'm not bashing lawyers here at all,even though it may seem so...

The facts in this accident are very plain and simple.... Our insured driver made a left turn from one state highway onto another state highway right in front of a 1 ton dually pulling a 30ft. gooseneck trailer that was traveling at or below the posted speed limit....That driver did everything humanly possible to avoid a collision,he could not and hit the car broadside killing the rear passenger.... The insurance company I work for did indeed take FULL (100%) responsibilty for the accident and within 10 days offered the parents of the deceased the FULL (100%) policy limits along with a copy of the policy. They said they would think it over,the next day we got a letter from an attorney (actually 2 different firms) saying they were representing the parents of the deceased and all correspondence was to go to them,they requested the insurance policy and were given them and the same offer of the policy limits.... The two firms also wanted all our investigative info on the other driver with his insurance provider and any other info we had on him (they were too lazy to get their own copy of the accident report with all this info from the state police,they charge a whopping 5 bucks for them)....

This is a clear cut case,our driver was at fault,everyone admitted that,we offered full policy limits within a very reasonable time frame,they refused,what else do they expect to get????????The offer was in the six figures and I have seen cases involving deaths settled for a lot less....

BTW,the girls left school an hour early to go to a retirment party for a teacher,they all had signed permission slips from their parents giving the school permission to let them out early,they are on record in the school office....Guess who else is being sued,the school-school board,and the principal for letting them out early....with their parents knowledge and consent!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Also,I do not neccassarily blame the lawyers here,we have found out the parents are the ones behind these actions just as much if not more than the attorneys....Evan,all this came about after depositions were taken from all parties invovled as well as all witnesses,as well as the school personel..... All the facts were "discovered" and put on the table for all to see....

BTW;here in Louisiana anyone can sue anyone for anything without any fear of retribution or other consequences... We have no laws form stopping frivolous law suits that I know of....

I really do not believe the insurance industry puts out propaganda as you state,facts are that there are some insurance companys that do not want to pay their claims,I'll be the first to admit it,I have to deal with them on a daily basis as well,but you do not want to get into a pi$$ing match over who's worse,the big bad insurance company or the personal injury (ambulance chasing) attorneys that buy accident reports from the cops and contact accident victims begging to take their case as soon as they get home from the accident!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!Evan,for every story you call tell about the big bad insurance company,I'll tell you two about unethical and illegal action taken by lawyers that I have personally dealt with.....

Ron;again I'm sorry about posting this after you said to move it to another place,please accept my apology and move this where ever you think it belongs....

David
