Russ-NASCAR never abandoned any of it's products/images for 20+ years and then started sueing people.
It was Shelbys idea.Yes.But the legend was created by the OTHER people he surrounded himself with.
Want proof?Look at that pile of junk Series one-enough said on that.
No matter what you think-the body(shape) is property of A.C.-Federal court says so.
He dropped the ball-along time ago.Someone else picked it up and scored a touchdown.
He nows whines like a 10 year-old sand lot ball player saying that"they" shouldn't have picked up "his" ball as he wasn't aware(didn't care at the time")that he dropped it and the touchdown shouldn't count because he wasn't watching.
Waaaah,waaaah.Go eat some chili,Carroll

Well stated opinion .
At the end of a long day....I still love his cars and what he "assembled"...and if the guy would not hang around barristers...i'd probably....................really like him.

Russ, All good points and I respect your point of view. There are many points of view on this subject. I really enjoy my cobra but just won't give CS all the credit for it. It is not an exact replica, CS never used a stroked 351W in any of his cars. (to my knowledge). CS was a great driver, builder, ect. but I lost respect for him. Mike Tyson was a world champion boxer but I don't respect him either. I too refuse to have any "CS" items on my cobra...sorry thats just how I feel. I also try not to "bad mouth" CS when i'm out and people ask me about the car. I protest quietly, (with exception to this post). I always try to remain flexable in my opinions and am open to people who believe differently than I.
respectfully submitted for viewing,
Flatliner

The way I see it, CS has been putting down the replica owners every chance he gets lately. I know of three cases. The jab on Barret Jackson. The article in a Magazine recently (Mustang something). Another TV show not too long ago did an interview with a similar jab.
This kind of attitude toward his biggest group of fans is the reason Shelby is catching so much flak. A Few years ago you never heard anything negative about Shelby. The reason is, he wasn't attacking replicas or their owners as a bunch of "copy cats".
If he were to stop the negative comments in the magazines and tv shows and confine it to the Courts, we would hear a lot less on this subject. Ed

It IS about money. Tough having such mixed feeling about a guy you grew up practically worshiping!

Don't kid it's the money. How many times has he been married? The last I heard it was into the double digits. Even in Nevada, divorce doesn't come cheap.

I think that while money was certainly a factor I also believe that he feels the replica industry dis'd him.
The replica industry are not blame free either.
There is always three sides to a storey.
One thing is for sure. We certainly don't help or advance our hobby and the love and popularity for the Cobra and its history by bashing and trashing its creator.
Just a thought.

I don't intend to bash Shelby but it's all a matter of who's "Cow is being Gored". I own two Shelby mustangs and recently purchased a SPF. The real friction occurs when money is at stake. Nobody ever imaged Cobras or Shelby mustangs would ever amount to anything but another hot rod. Even after sucess on the track, no one really care whether these cars live or died less more who was responsible for their sucess. The Cobra only lives because a dedicated set of hard core enthusiasts/collectors kept the legend alive. Now that the legend has transcended time and is living in the form of the replica/kit industry it doesn't seem fair. Why ?? Because there is money involved. Some may say BS but I don't see Carroll going after people who modify their mustangs to look like R models or street Shelbys with the same amount of vigor. How many Shelby clones are on Ebay today fetching big bucks!! If someone started a business called "Clones are Us" how long before blood sucking lawyers are at the door seeking copyright infrigements. Again it depends on "whose cow". For the final straw, how about the GT500E with its $125k price tag. Ask any 65-70 Shelby owner how this "bag of bolts" ever commanded such a whopping price tag and is worth more than the originals. Should Shelby owners file suit that the 500E is a replica since the 67 Shelby mustang has been out of production for 36 years. Wait I forgot; these are continuation cars that were assigned but never built and Carroll Shelby is giving everybody a second chance to own an original. So you see it really see " It depends on whose cow is being gored". Let the flames begin.

Blood sucking lawyers???
Lawyers represent clients who have retained the lawyers who are asserting what the client believes are valid claims.
Some win. Some lose.
Everyone hates a lawyer until they need one.
BTW: Its the "Ox" thats gored. Not a cow.

Thats why they call cases a contested matter.
Both sides think they are right. Actually, in some cases both sides may prevail in part.

this reminds of all the back and forth my wife and women who collect depression glass (or anything else for that matter). Reproductions are becoming rampant. And with a piece of glass (or fiesta ware), if it uses the same mold or a mold taken from an original piece, is it any less desireable than an original...and if using the same mold, how do you tell (it's glass, glass is glass...)
On and on and on and on and round and round and round...
And twenty years from now, how will you tell if it's 20 years old or 40 years old?
If some one or company was foolish enough to sell off the molds or neglect to copyright the shape/design, than I can't work up too much sympathy for the people reproducing the old designs. Like keeping up the copyrights on books and movies and likenesses (how much did Elvis earn this year?).
