I did not contribute any negative observations as to the drivability of the Cobra. The lawyers were armed with a report on the deceadents blood alchohal level and tox screen. It wasn't good.
I did not wish to stir things up, as a death was envolved in this incedent and that will never be forgotten, as well it shouldn't. There are many who are still quite stirred over this tragic event. Prosecuters are out for convictions. If the serviving driver is convicted of crime/s that may very well open up a nasty can of worms for any who were envolved in the high performance alterations of his "street licensed" car, for financial gain. As the owner of an automobile repair facility, I have concerns about what may come about from the legal aftermath of this incedent.
Racing is dangerous, even with the best of safeties in place. I am ademently opposed to street racing, with good reason, as I servived one very nasty incedent envolving being upside down with raw fuel everywhere, and no one to render aid. I got lucky. I don't do high performance mods on street licensed autos, as I feel that contributing to such a life threatening, illegal exebition of speed should be criminal.

I feel the only thing in the past, is the past (the incident). The future that interest me is the legal outcome. Why do you say that I am "creating further conflict"? I'm just stating my views. If they differ from yours, fine, so be it. I'm not into conflict. I just feel racing is for the track.

So what do you consider a "high performance mod" to a Cobra replica? As a specialty built vehicle there isn't exactly a baseline of "stock".
Just because someone owns a high performance vehicle does not mean that they will be racing it on the street!

The Modifications issue in this case is not bearing on the Cobra replica, it's the Trans Am.
The owner of an automobile (in Iowa) can modify their own car as long as no emission devices are rendered inoperative or the modification does not cause excessive emissions and no factory safety devices are tampered with. As to a repair facility installing performance mods, this is a grey area. No equipment is to be used on a common motorway deemed "for off road use only". Although, as of yet, I am not aware of any statute regarding the installation of said high performance mods by a bonified repair facility to be illegal.
This may change in the future as there have been several street racing related deaths recently in Des Moines.

In Hawaii you can apply for an "alteration/modification" exemption. The modifications law is rarely enforced however. Typically it is used when someone, or a gathering of people are suspected of street raceing but the police cannot prove their case. Non standard mufflers, wings, body kits, engine mods etc. have been cause for a substantial ticket. I've never personally heard of anyone actually applying for an exemption. The various and MANY mechanic shops are not regulated by law as to the mods they do on a car, that is the owners problem.
There have been street racing accidents resulting in death of OTHER drivers who were NOT street raceing at the time. The most recent involved a family on their way to church, the mother was killed. The community went ballistic, resulting in harsh new laws. Your car WILL be confiscated if your caught street racing. A second offense can result in permanent loss of your license.
There is fine line between chirping the tires and driving fast and "street raceing". Many of us have driven "fast" on the highway and "chirped" our tires. At the wrong place and the wrong time we could easily cross the line from "having some fun" to "street raceing".
I don't know in Marks case how it really went down. I like to think he recognized he was to close to that line and was trying to get out of a bad situation. I will not cast blame on either driver because I do not know the facts. The Courts will determine the issues here when ALL the evidence and mitigating circumstances are considered. My heart goes out to the familys involved in this tragedy.

You should have started a new thread on the subject matter at hand, instead of using this one. The views you state are fine, the ulterior motive is not. It seems to me like your trying to define what is, and what is not correct., or properly defined per the laws on the books. Yet you yourself, being in the business of working on automobiles, seem to be striving for something else....What that is remains to be seen. Again, just my view of your postings on this thread so far..................
