Just to reiterate guys, plates or not plates, VIN or no VIN, the law says 'registerable', and hence they use this flimsy justification to ticket just about anything. You can remove whatever you like, but if the person offering the ticket wants to ticket you, he is correct within the letter of the law.
How did it get this way? Because as motoring enthusiasts we didn't stand up for ourselves soon enough. The Hot Rod guys are onto a good thing. Why? Because they got organised in the 70's. If you want this kind of rubbish to stop, next time other clubs approach discussing the issues faced by ICVs in NSW, spare a thought and offer up some time to help out - else we'll all be left driving '33 Chevs and the Cobra, GT40 and Lotus 7 scene will die.
I'm from the UK, I've seen how easy it should be. Even I am fed up with the lengths that I have to go to when it comes to certifying our cars. Lets all get together and get this sorted, else the Police will have a field day with rights granted by the RMS and the EPA for noise levels and all kinds of other heinous legislation that most of us won't have the time to fight.
Or you can sit back and say 'my Cobra has NSW plates, which makes it more valuable, so why should I help', which I have heard in the past and made me want to drop the arrogant wanker that said it.
I've mentioned in the past that I certify ICVs to help out guys in the hobby; I have a Monday to Friday job which I would enjoy a whole lot more if I wasn't spending 4 hours a night trying to sort out this kind of crap from the RMS. I'd probably still be married, too.

...so if the car on the trailer has slicks, or non ADR approved windows, or is otherwise obviously in violation of a roadworthy, how can they fine you for what is obviously not a "registerable" vehicle?

CMY-427 - In future, don't believe everything you read. Take the time to research it before shoving it on the forum. Make inquires from those who may have been at the event by way of a query or PM on this or other forums. You will then obtain a true account of what actually did occur instead of taking for granted, some crap that an anonymous person has posted on Facebook. Any further comments or photos that you then submit after verifying the authenticity of the thread will be factual instead of perceived.

CMY-427, no offense intended. Perhaps if you find relevant information on other forums it would be better to link to those forums rather than uploading the evidence to your personal photo bucket account. We're not bullying you either. We just happen to take these matters seriously.

Sambo, I'm not a member of the fb site that it was posted on, I think someone on my fb friends list either "commented" or "liked" that post, it then appeared on my page. I'm pretty sure that if I had just posted the link here it would've only been seen by members here that were currently "signed in" to fb, anyone else would have been re-directed to the "sign in" or "sign up" page, thats the reason why I saved it to that photobucket site, so it could been seen by everybody...

Fair enough but the photo has clearly been manipulated and we're yet to hear from anyone pinged during this supposed blitz or see a first hand account on a public forum. It makes the police look bad and does nothing for the goodwill that we work hard to keep with the authorities.

Look within the Road Use Management Act 1995.
A registered car CAN be issued with a defect notice at ANY time!!!!.......
A police officer, or the Authority, may inspect a registerable vehicle (whether or not on a road or road related area) for the purpose of deciding its identity, condition or the status of any registration or permit relating to the vehicle.
...and any vehicle which is being towed by a Registered tow truck is exempt from requiring registration.

So, I have 2 unregistered (but formerly registered) projects in my garage, and if the local Boys in Blue wanted to they could fine me for them being unroadworthy?
Can I stil urinate on the left hand drivers wheel of my buggy, or is law no longer on the books

Smokey, the way I'm reading it from the posts it seems that if the car is "currently registered" - that being with rego plates and current rego sticker attached you may be open to being pinged.
If you have 2 cars in your garage that are currently "unregistered" - that being not with either of the above plates/sticker, then I don't believe you will fall into the above category and are free to pee on as many LH front wheels as you like.

Guys, the detail you are missing is 'registerable'. Registered or not, if it is 'registerable', they can do you.
We've brought this to the Minister's attention and they are looking into changing the wording.

Treeve, I did miss that...
My car received import approval as being able to be a "registerable" LHD car under the 30 year rule so best I keep the trailer doors locked!
I think a review of the wording of the legislation is a good idea.

The devil is in the detail but it goes both ways in that if you were to inform the Authority that the vehicle was in fact unregisterable they would then have no cause or in fact right to view the vehicle on private property!!
..without the appropriate paperwork or your authority!!"
"By the laws of England, every invasion of private property, be it ever so minute, is a trespass. No man can set his foot upon my ground without my licence, but he is liable to an action, though the damage be nothing ... If he admits the fact, he is bound to shew by way of justification, that some positive law has empowered or excused him."
"'The poorest man may in his cottage bid defiance to all the forces of the Crown. It may be frail - its roof may shake - the wind may blow through it (NOT EVEN THE BIG BAD WOLF) - the storm may enter - the rain may enter - but the King of England cannot enter - all his force
dares not cross the threshold of the ruined tenement.' So be it - unless he has justification by law.
"The principle applies alike to officers of government.....
Again on a trailer as in the OP...plates and rego label you are indicating the car is in fact registerable in its current form...remove both of these and be steadfast in Stating the car is unregisterable in its current Livery you will not have an issue!!
Guaranteed a ticket if your pi$$in in line of sight!!!

Actually, you've missed the point - you can't just say it's unregisterable - it's another power they've been granted under the anti-hooning laws for unregistered vehicles being used. If you were to change out normal wear and tear items such as tires, or standard components frequently modified such as the exhaust, and return it to registerable trim, then plates or no, (stickers are gone soon, so lets ignore them), your car is registerable. This means unless you have something in particular which is unregisterable by the RMSs own rules (eg full cage in a sedan), then tough cheese, they've got you. And this is the injustice whereby the police are given extreme powers because 'Today Tonight' gets a whiff of a hoon story.

txhoang Did you mean this ??? :-
There was a chemistry professor in a large University that had some exchange students in the class. One day while the class was in the lab, the professor noticed one young man, an exchange student, who kept rubbing his back and stretching as if his back hurt. The professor asked the young man what was the matter. The student told him he had a bullet lodged in his back.
He had been shot while fighting communists in his native country who were trying to overthrow his country's government and install a new communist regime. In the midst of his story, he looked at the professor and asked a strange question. He asked: "Do you know how to catch wild pigs?"
The professor thought it was a joke and asked for the punch line.
The young man said that it was no joke. "You catch wild pigs by finding a suitable place in the bush and putting wheat on the ground. The pigs find it and begin to come every day to eat the free wheat. When they are used to coming every day, you put a fence down one side of the place where they are used to coming. When they get used to the fence, they begin to eat the wheat again and you put up another side of the fence. They get used to that and start to eat again. You continue until you have all four sides of the fence up with a gate in the last side. The pigs, which are used to the free wheat, start to come through the gate to eat that free wheat again. You then slam the gate on them and catch the whole herd.Suddenly the wild pigs have lost their freedom. They run around and around inside the fence, but they are caught.Soon they go back to eating the free wheat. They are so used to it that they have forgotten how to forage in the bush for themselves, so they accept their captivity."
The young man then told the professor that is exactly what he sees happening in Australia .The government keeps pushing us toward Communism/Socialism and keeps spreading the free wheat out in the form of programs such as supplemental income, tax credit for unearned income, tax exemptions, unmarried mothers support, carers income support, payments to illegal immigrants, welfare, medicine, drugs, etc, while we continually lose our freedoms, just a little at a time.
One should always remember two truths: There is no such thing as a free lunch, and you can never hire someone to provide a service for you cheaper than you can do it yourself.
If you see that all of this wonderful government "help" is a problem confronting the future of democracy in Australia , you might want to send this on to your friends.
If you think the free ride is essential to your way of life, then you will probably delete this email.
BUT, God help us all when the gate slams shut!

Bugger that for a lot of work for a bacon sandwich. I just shoot them with my bow (but make sure there is a climbable tree handy if you aren't a good shot).

Now see there is the devil in the detail "RMS!!!!".....Common sense!!!
...the anti-hoon laws provide that if police have reasonable grounds for believing a DRIVER has committed a hoon-related offence.
Again the OP is in Question registered on a trailer and the authority is the EPA so if not VISIBILY registered they would have no legitimate access to the vehicle with it not driven or having committed an offence on private or public property..... the vehicle could also not be ticketed under the hoon umbrella!
Specific Hoon Offences=
Improper Use of Motor Vehicle – defined as “intentional loss of traction to
one or more wheels”
Careless Driving – with Improper Use
Manner Dangerous – with Improper Use
Engage in/Conduct Speed Trials Fail to Have Proper Control – with Improper Use
Undue Noise/Smoke – with Improper Use
Drive Whilst Disqualified/Suspended
Exceed Speed Limit – by 45Km/h or more; or travel at 145Km/h or more in a 110 Km/h zone ...
None of which can reasonably be performed..(alright by some maybe!!)..on the back of a trailer and hence be applied under anti-hoon!!!
If your being Defected under anti-hoon somebody else will be Towing your car home and not on your trailer!!!
So how does registerable or unregistered really apply if the extreme powers granted under anti-hoon can't be applied if an offence hasn't been committed? ...now there's a twist??...are we then back to the Common Law interpretations?
Sorry Treeve I'm bored!!
