My few dealings with professional photographers has left me with an unfavourable impression of them viz their willingness to use others efforts (the build of your car) to create their own 'art' and then claim the IP and seek royalties on the use of the image.

We had a photoguy follow my son's Hockey team and he was great. He shoots for Sports Illustrated. First name is Walt, can not remember his last name, sorry.
He did so many great shots. I think the guys who LOVE what they do, find the angle in everything.
This shot looks great with the clouds closing in on the plate light. Nicely done.
Just my $0.02 worth ( in todays economy that value has been adjusted to $0.005 )
Not scoop, third brake light...I think.

Nice picture Richard.
I had a battle with the photographer who took the shots for Street Machine. He was employed by SM but claimed the pics as his own.
I pushed and shoved and finally I got a complete set of original files. The photographer was able to sell the pics to a French car magazine and also a poster company.
All I was expected to receive was the "honor" of having my car featured in Street Machine.
I will add that SM did "ask" before they sold of the picks but when the question "what’s in it for me?" is raised things don't go well.
After my perseverance though I do have an excellent record of my car and I had printed 4 very large framed pics over my TV in my lounge.

I'd be pretty chuffed if someone took a nice photo of my car and it resulted in all those positive comments. And I'm not sure you have any more claims to copyright over that photo than Mr Shelby does over the image you have created of his original masterpiece.
Then again for physical objects I think we should be referring to patent law?
Did you have an agreement with the photographer at the time? Perhaps he could at least credit you in the side bar?

as I understand it as a pretty serious amateur, who ever pushed the shutter button owns the pics. It is considered intellectual property because of the "art" value. Even if he is working for someone else, he owns the pics and can give them or sell them to whom ever he wants. particularly if the photo was taken in public or from a position where he / she was on public property (ie....if I stand in the street, I have every right to photograph your house). I could be wrong, I am not a lawyer, but have had this conversation with lots of pro photogs before. It even came up in my divorce over family pics and since I shot them, they technically are mine, but since she owns half of the estate...blah blah blah....

This issue defines the word Grey.
I have no issue with people taking pictures of my car or what ever, but strongly feel that if it is done for a commercial gain then permission by the subject should be obtained, IMHO.
I have my car featured in ads for car shows and events that I was not even going to attend.
This raises another point of privacy, Richards number plate is in full view, does the photographer who is selling the pic have the right to sell his personal information....
That is why I try hard not to have my Number plates on my car at public/racing events; otherwise you have my number plate number, and sometimes my surname on the windscreen.
I accept the art value but don't forget common courtesy.

As Sambo mentioned, if you don't have an agreement in place in advance, negotiating after the fact is messy. Bottom line is that nobody is going to get rich off of royalties of Cobra pictures. Fun to look at...just don't see the mass appeal and demand.

A couple of clarifications. first, I realize we are talking about down under...I was going by US law. And second,, absolutely, I believe all of what you guys are saying. I think the whole thing would be a non issue with a little "please" and "thank you" and "for your help, I will email you a copy". That would be the only way I would do it. When I am at a car show, I even ask if it is OK to shoot the car. I have never been turned down yet. And if anyone said no, I would have no problem with that either. And if someone said that they would prefer that I not use the image for profit..I have no problem with that.
I was just coming at it from the "legal" side in the US as I understand it.....which I am not sure that I believe is the right way, btw. So, not disagreeing here!

The Yellow Colour of my car
The colour of my car is Devil Yellow from the Holden Monaro and the Pontiac Coupe. The Black has a green metallic mixed in with it to soften the black.
The car was painted in base coat then clear over the top to bring out the gloss.

Hi guys
This pic was taken without me knowing but we were that impressed , we had it blown up and put on canvas. I was made aware of the pic by someone that saw it and then told me. As for personal info well can't they just follow down the road and get number plate details. I would like to be able to take pics like this instead of the boring snaps that I tend to take.
