Default 11 grand gone, no kit delivered


Its been 14 months since I ordered a kit from Ryan, doesn't answer his phone or email. This the 1st time in 35 years that a car guy has ripped me off.

Ryan Martens bought the rights to classic roadsters and set up business in Regina.
I have gone to the local police but they say its a civil matter and I have to sue him in court.
I'm putting this on the forum so nobody else gets their money taken.

For 11k I would have knocked on his door a long time ago. Sometimes all it takes is a little nose to nose to set things straight. Ask Ron61 about how his Daytona sat at a guys place for 5 years and how easy it was to go and get it.

I'm somewhat surprised they'd take the view this is a civil matter. It seems to me this looks like fraud - and that's a Criminal Code matter.

I'm sure you got your monies worth in aggravation and frustration. Now you get to be confrontational and fight to save face. You can probably spend at least another $11K try to recover your first $11K. Not likely you will come out whole. Good on you to warn others. I wish you the best and hope you can get past it.

I understand that there are a lot of people out there in the world who want to do this or that, but never seem to plan and and never manage to come up with the money. If you sell them something, they may never come back with the money and actually complete the sale. So I understand a manufacturer wanting to know that they are dealing with a real sale.

What I do not and never will understand is how this industry continues to operate on a give me all the money (or at least half), and maybe I will build your car, when I get around to it, plan. I'm pretty sure operating this way leads good people into temptations that are risky to say the least. Often times your money goes to building someone else car and they have to sell two more to get the money to build yours.

It would seem to me to be a fair and equitable model to put 110% of the money to build your car into an escrow account, managed by a 3rd uninterested party. As the car is built and the builder proves the progress made, the money is released at mile stones that were negotiated up front. This was once typical with home builders.

Perhaps some of the builders are doing exactly what I am saying, but when I was looking 10 year ago, none would even consider my proposal.

My experience was different because I could go to the SPF dealer pick out the roller I wanted pay the money and take it home. When you get into a custom build, then the escrow account, milestones and progress payments are pretty much the normal way two strangers approach this type of a transaction — olddog nailed it!

Can you imagine what you would hear if you went to a custom builder, told him you wanted one of his cars and you wanted to drive it for a year before you paid him because you needed to be sure it was as he described it?? Yup, he wold have unkind words for you and you should have the same words for a custom project you are required to pay for up front on.

I remember when the guy was asking for someone to send up their car because he needed a frame (as all he had where the bodies /body molds) and he would return a completed cobra in return...

The offer was tempting and when I called to talk to him about it, I mentioned to him about using a escrow account where he would put some $$$ until I got the car back. He went on and on about this and that and how his wife was in the police force.... It smelt a little fishy to me. Then someone else offered their kit.

He later was asking for a radiator hoop as the mentioned kit didn't have one. Talking on the phone I offered to send him dimensions of the one I had... He started to going on how he had a quarter million operation held up because I needed a radiator hoop AND his welder/fabricator could not create one off of measurements and needed a physical one… A radiator hoop is pretty simple thing to rig up all things considered. That was a red flag for me…

Looking back I wished I threw the flag into the forum but by that time people had started coming about lack of response for this guy.

I just heard that there may be a buyer for the company and if it goes through I should get a refund........so I will give him a bit more time before I start legal procedure.

Absolutely correct. In the event of a sale, legal liens and claims against the company are first in line to be paid. Get a lien filed against the company as soon as possible so it is registered during the legal proceedings of the sale. Don't rely on hearsay to get your money back. Talk to a lawyer ASAP.
