Yeah Randy is right. I took a copy of that "policy", (printed in color) with their own letterhead on top, into the local BAR office and got the deer-in-the-headlights look!
I showed it to 2 different BAR ref's and they both said they had never seen it!
Pointing to a wall of binders, they both said that when it shows up in there, they would honor it.

I also asked them both, when not in front of each other, about service blocks, and got 2 different answers. One said first year of use, the other said last year.

With all of it's regulations, BAR is still a 'crap shoot' when it comes to these cars.

SB100 # is the 'Trump card' for Cobra registration in Cali!

Entering the amnesty program allows the owners illegally registered vehicle to be correctly registered and avoids the criminal liability of perjury for lying about the year of the vehicle.

This does not grant any kind of “engine amnesty.” All it does is place you back at square one by correcting you registration and making sure you comply with existing California law.

For those who choose not to accept amnesty, the bill does contemplate “stepped-up vehicle registration enforcement programs.” Last I remembered the rule was that an illegally registered vehicle was subject to tow and impoundment and the perjury is a non-reducible felony. I do not see much leniency in future enforcement actions following an offer of amnesty.

My thoughts for what they are worth.

Robert,

Can you show case law that allows California and it's division of motor vehicles to trump Federal laws that govern the titling process? Again I'm not trying to give you a tough time, just trying to understand the laws as written on both a Federal and California state level.

I would encourage you to do some research. Google is a great search tool.

You seem to be under the mistaken impression that kit cars have some sort of federal title. A kit car, by its very nature, is designed to be outside the vehicle manufacturing regs. This is why there is no VIN number assigned to them. The first time these cars are entered into a system is at the state level. Some states have specific rules for these vehicles; some have no rules at all.

If you become a resident of a specified State you must comply with that State’s laws. A good analogy to your “registration question” is firearms and fireworks. Just because it is legal to possess or own a particular type of firearm or firework in State A does not entitle you to keep those objects if you move to State B where they are illegal.

sounds like another way to squeez more money out of everybody and give the DMV more work that they can't handle.

"Squeeze" more money may be accurate, but in this case it's fair and straight forward. Pay if you wanna play.

Money DOES seem to be the driving factor. Mr. Morgester has stated before that HUGE sums of money are in play here, revenue lost as far as Calif is concerned. While one might question the actual amount, there is no question the State believes it's BIG money at stake.

Along with amnesty it's a shame more SB100 numbers have not been allocated. THAT makes amnesty a very hard pill to swallow, and makes very little sense from a 'collecting' money stand point. I gotta wonder, what the hell is REALLY going on? Seems to be more to it than money, all thought thats the EXCUSE the State is using...
