Please support AB 390 - repeal of exhaust noise law
Hello all,
Please use the link below to contact your CA Assembly reps to request support of AB 390. This bill is intended to repeal the 2018 (effective 1/1/2019) law (AB 1824) that eliminated "fix-it" tickets for exhaust noise violations.

The thing that puzzles me is that if you do get a ticket, it won't be a fix-it and you'll have to pay the fine. What's not clear to me is, what happens then? Can you just continue to drive and take your chances on getting another ticket?
From my point of view, this was a move to generate revenue. Either way, I'd just as soon have the LEOs be able to use their discretion about what sort of ticket to write.

First my background than my 2 cent option....retired 2 years ago from a mid size city in central California. Of my 32 years, the last 15 were spent on motorcycle (yes, I was that “guy” who wrote tickets). I can’t speak for other officers, but......
In my time on a MC, I wrote several exhaust tickets....all of them were to the foreign cars with the high pitch bumble bee sounding can hanging out the back. They got tickets because they decided to draw attention to themselves either at a red light or in traffic by revving their engines as if to say “hey look at me”. And I did.
The guys with the muscle cars (cobras) who rumbled at the red light, didn’t rev their engine, and pulled away with traffic smooth and easy were looked at. I would try to find every opportunity to get next to them at the next light, to talk about their car, and give them a thumbs up.
It’s all about presence and respect. If you think with your brain, instead of your right foot, then chances are the only contact you will have with LEO’s is that random thumbs up and their envy.
As for the fix it part....once the loud exhaust correction is made, then an officer signs it off and it usually is a $25 admin fee paid to the court. IF the offender is stopped again with the same violation (as in the owner undid the fix to make it loud again) then the officer or the judge has the discretion to make the citation “non correctable” or a nuisance. The fines can run as high as $500+ for repeated violations.
I know my opinion is just one, but 99% of the guys I worked with had the same basic philosophy. “If you don’t want my attention, don’t scream for it......and if you get it, don’t blame me”.

Dear John; I am not in law enforcement, but I did commute from the central valley, to the bay area every day, for 20 years. I can tell you those little imports, zipping in and out of traffic, were a pain in the a$$ . Glad to hear you were doing your part. Buy the way only one ticket for a yellow light by a city cop in palo alto. Not bad for 20 years I think.

The change in the law has nothing to do with public safety, and arguably nothing to do with a public nuisance...there are obviously laws already on the books...which are variably enforced (as highlighted by the LEO posting above). The problem that I, and that I suspect most of those of us critical of the change have, is that this is obviously nothing more than another money grab by the politicians in a state already known as one with one of the highest tax rates in the country.
Its bad enough that every possibly interaction with government in this state involves exorbitant "fees", but increasingly, law enforcement is being used as a revenue machine rather than in the interest of public safety.

Maybe if we could get liberals, to build more factories and conservatives, to build less jails,
there would be less crime and more money, to spend on important things, like my car.

Maybe if we focused less on politics and more on the issue this thread would be a more enjoyable read. I guess that would apply more broadly to CC as well.
I didn't join CC to engage in political discourse - there are plenty of other, more suitable forums for that. YMMV

Opponents of the front plate requirement have tried for years to garner support for it's repeal, I don't see this legislation gaining any traction either.
